Boeing engineers union likely to back mediation talks

(Reuters) - The union that represents Boeing Co engineers is likely to agree to mediated talks in a bid to resolve the standoff with the planemaker, the executive director of the union said on Friday.

On Thursday, Boeing asked for U.S. mediators to help resolve talks with the Society of Professional Engineering Employees in Aerospace (SPEEA) union, which represents its 23,000 engineers, saying the sides were far apart on pay and benefits.

That move halted labor discussions around midday on Thursday in Seattle, and no further meetings were scheduled, the two sides said. Union contracts with Boeing expired on Sunday.

"We will almost certainly agree to some type of mediation, but we find the company's position confusing," Ray Goforth, SPEEA executive director, said in an email to Reuters.

Goforth said Chicago-based Boeing had not responded to many union proposals and that a lot work was left to do.

"We view this action on their part as a stunt to distract people from the proposed pay and benefit cuts," Goforth added.

The union has balked at a Boeing contract that it says would cut the growth rate of compensation of professional and technical employees. Boeing says its latest offer is much improved over its initial proposal and reflects a tough competitive environment.

The breakdown in talks comes as Boeing looks to speed up jet production from 52 a month to about 60 a month by the end of next year. A walkout by the union could stop production.

Peter Arment, an analyst with Sterne, Agee & Leach, expressed hope that the dispute would be resolved with mediation. He noted strikes by SPEEA were rare, with the last one occurring in 2000.

"There's still time for this to be resolved long before it would affect Boeing's commercial aircraft production," Arment said.

Shares of Boeing edged down 3 cents to $74.09 in Friday trading.

UN nuclear chief urges more cooperation from Iran

(AP) ? The head of the U.N. nuclear agency says he cannot provide a "credible assurance" for Tehran's claims that all of its atomic activities are peaceful.

Speaking Thursday at a board meeting of the 35-country International Atomic Energy Agency, Yukiya Amano also expressed concern over Iran's "activities" at Parchin, southeast of Tehran.

His experts want to visit the site amid suspicions that it was used for secret tests related to nuclear weapons developments. His language is diplomatic shorthand for an alleged cleanup at the site.

Iran denies any interest in nuclear weapons and says it never tried to develop them. It dismisses concerns that it is enriching uranium for possible use as the core of a warhead, saying it wants only to produce reactor fuel.

Hospitality industry executive, business school alum makes major ...

There are few people who were as excited about the addition of the Hospitality Management Program at West Virginia University as Mike Bodnar. He has been a major supporter of the program that is well on its way to becoming a major in the College of Business and Economics, and now Bodnar is putting his money, well, where his heart is.

A highly successful restaurant executive and president of Bodnar Investment Group, Inc., J. Michael Bodnar, a Nashville, Tenn., area resident, has announced a gift of $1 million to B&E. The gift is the latest in a long line of giving back to the business school where he earned a M.B.A. in 1969, and will be divided into two equal parts ? $500,000 to establish the J. Michael Bodnar Entrepreneurship and Innovation Endowment and $500,000 for the J. Michael Bodnar Hospitality and Tourism Support Fund.

?I am happy and honored to announce this gift to the College of Business and Economics,? said Bodnar, who was named to the inaugural class of the WVU College of Business and Economics Roll of Distinguished Alumni in 2011. ?The College is making great strides in the areas of entrepreneurship, innovation and hospitality, and those are things I am very passionate about in my life. It?s important to me to provide this kind of support, which will only help the College advance in these areas.?

Bodnar, along with fellow alum and business partner Doug Van Scoy, donated a Taziki?s Mediterranean Caf? to B&E, which opened in August 2010. The restaurant operates in WVU?s Mountainlair and sees net profits directed to B&E?s Hospitality Management Program, operating also as a working lab for students in the program. In fact, he and Van Scoy were instrumental in the initiation and development of the program, and both serve on the program?s advisory board.

After earning degrees at WVU in civil engineering and his M.B.A., Bodnar has had a highly successful career in the hospitality industry. While there, he and Jim Clutter ? another WVU graduate ? developed the back-office system that became the Back Office standard for Wendy?s. Over a decade, he built the business into a public company, Restaurant Systems Inc., with more than $50 million in annual revenue and in 1986 merged with Wendy?s. He was a Wendy?s franchisee in New York City until 1997 with annual revenues of $60 million and served on the Franchise Advisory and National Advertising Council, winning numerous awards for his successful operations.

After turning his focus to restaurants and real estate, he founded Bodnar Investment Group in 1986, a company that develops real estate, provides start-up equity and provides consulting for restaurants. He has developed several restaurant chains, including Maxie?s in northern Florida, El Polo Loco in Las Vegas, Taziki?s Mediterranean Caf?, Baha Burgers, Tellini?s Italian Caf? and Martin?s BBQ. In 1994, he partnered with Nick Pihakis to develop Jim N? Nicks BBQ, which has grown into a chain of 30 restaurants and annual revenue in excess of $100 million. In 1999, he was named CEO of Shoney?s, one of the largest restaurant chains in the United States. His other business ventures include his co-ownership of Sunlight Mountain Resort in Glenwood Springs, Colorado.

In his current position with Bodnar Investment Group, he invests and develops restaurant chains using his experience and knowledge of branding, quality food products and operational expertise to help young restaurant entrepreneurs develop their local concepts into national brands.

?It?s very rewarding to support programs at my alma mater,? Bodnar said. ?It?s a good thing when you can help your university mold minds, develop skill sets and tap into the passions of students. WVU?s business school is doing great things, and I certainly want to be a part of that.?

In Egypt and Tunisia, Salafis move from prisons to parliaments

Mehdi Mezmi rediscovered Islam eight years ago via a website, then illegal to access in his native Tunisia, called Minbar at-Tawheed wal Jihad ? ?The Forum for God?s Oneness and Holy Struggle.?

It seemed to him a dark time for Islam. Afghanistan and Iraq were under US assault. At home, President Zine El Abidine Ben Ali was jailing the pious under a new anti-terrorism law. Mr. Mezmi read about the struggles of the early Muslims, and was inspired.

?I felt the prophet was talking about our times and what was happening in the world,? he says.

Today Mezmi works as a tugboat engineer in Tunis. He?s also part of a deeply conservative ? and sometimes violent - Islamic current known as Salafism that has gathered force in North Africa since the 2011 uprisings. It's inevitable that Salafis will help guide their countries? evolution. The challenge for governments is to make sure they do so peacefully.

Salafis made international headlines in September with assaults on US embassies in Libya, Tunisia, and Egypt. While they have mainly acted as pressure groups so far, some leaders fearful of violence want to steer Salafi activists into politics instead.

?There must be zero tolerance toward violence,? says Said Ferjani, a political bureau member of Ennahda, the moderate Islamist party that leads Tunisia?s coalition government. ?We have to bring them into the sphere of intellectual and theological debate, because where there is debate, you can challenge their views.?

REVERSION TO 'EARLY ISLAM'

Salafis are Sunni Muslims who aim to emulate Islam?s first three generations, called ?salaf? in Arabic, in a quest to transform society. But views differ on the right approach. Many Salafis simply try to set an example. Some get involved in preaching and charity work. A minority embrace varying degrees of violence.

The evolution of Salafi thinking dates to medieval scholars such as Ibn Taymiyyah. His call to scrap centuries of jurisprudence and return to the ?pure? Islam of the prophet Mohammed's time has inspired generations of fundamentalist reformers.

One was the 18th century scholar Mohammed Ibn Abdel Wahhab, who branded other Muslims infidels ? a widely reviled practice called takfir ? and teamed up with the Al Saud family to seize control of central Arabia. His teachings now form the basis of Saudi Arabia?s state creed.

Most Salafi scholars, however, have warned against getting into politics. Sometimes called Scholastic Salafism, this school of thought urges Muslims to live piously and invite others to do likewise.

Both Salafis and more moderate reformers have long debated issues such as takfir, the concept of holy struggle called jihad, and the role of sharia ? the comprehensive understanding of how Islam guides life. In recent decades a new discourse has offered stark answers.

Forged in the crucible of the 1980s Afghan war, the violent fundamentalism of Al Qaeda and its cheerleaders demands direct application of sharia, depicts Islam as under attack ? including by some Muslim-world governments ? and calls on Muslims to fight in its defense. Those who do so are often called Salafi jihadis.

MAKING SENSE OF LIFE

Meanwhile in North Africa, the regimes of Tunisia?s Ben Ali, Libya?s Muammar Qaddafi, and Egypt?s Hosni Mubarak spent decades trampling dissent, letting unemployment skyrocket, and seeking to varying degrees to control religious life.

For some North Africans raised in the bleak landscape of authoritarianism, Islamic activism offers meaning, says Isabelle Werenfels, a specialist on the Middle East and Africa at the German Institute for International and Security Affairs, in Berlin.

?Many of the people termed Salafi don?t really know much about Islam,? she says. ?These are young people who don?t have many choices. They?re looking for a way to give sense to life.?

Mezmi has studied Islam for longer than many young Salafis, but he waited five years before he dared let his beard grow ? a good way to attract the police in Ben Ali?s Tunisia. His friend Hamza El Arabi, an engineer at a plastics factory, also studied discreetly. The two men grew up in El Kram, a working-class neighborhood of Tunis. One recent evening they were sharing an outdoor caf? table with their friend Redouan, also a Salafi. Inside, dozens of eyes were glued to a soccer match on TV.

?Before, it was like I didn?t have an identity,? says Redouan, 26, who began studying Islam in 2010. In jeans and sneakers, he and his friends still look like most of the other young men at the caf? ? save for their beards. ?I was drinking and playing cards. And in Islam I found my identity.?

A SLIDE TOWARD INTOLERANCE

Since last year, a growing number of North Africans ? mainly young men ? has translated that sense of identity into action. Most Salafi activism has been peaceful. But violence has risen, from messy scraps between police and rioters to religiously-driven vandalism.

In Tunisia, Salafis have done charitable work and called for religious freedoms ? such as lifting restrictions on Islamic dress ? denied them under Ben Ali. But some have also lashed out at what they call blasphemy.

Demonstrations last year against a Tunis TV station that aired the film ?Persepolis,? which contains an image of God, ended in rioting. Last June Salafi activists trashed an art show on similar grounds, with similar results.

In Libya, Islamic hardliners have wrecked several mosques associated with Islam?s mystical Sufi traditions. Sufis often congregate around spiritual leaders they believe transmit God?s blessing, and bury them inside mosques. To Salafis, that can look like witchcraft and polytheism.

?If these people controlled the country they?d kill everyone,? says Abdelbaset al Turki, a relative of Sheikh Abderrahman al Turki, who since 2003 has led the Sufi community at the Zaouia al Shaab mosque overlooking Tripoli?s harbor.

One morning in August, Abdelbaset al Turki watched Salafis bulldoze the Zaouia, pick-axe open graves, and pull out four bodies including Sheikh Abderrahman?s father and grandfather. Nominally pro-government militiaman on gun-mounted pick-ups blocked any interference.

Now the Zaouia al Shaab Sufis frequent the home of Sheikh Abderrahman, a converted garage, where one September afternoon Abdelbaset al Turki and his brother, Fathi, were having tea. Photos of robed figures hung on the wall. The men say rigid Salafi doctrines contradict Islam.

?Sufis know the history of Ibn Abdel Wahhab and the Wahhabi discord, and stay with the true belief,? says Fathi al Turki.

Just weeks after the Zaouia al Shaab was destroyed, four US diplomats were killed in an assault on the US consulate in Benghazi that US officials blame on a local Salafi Jihadi militia with possible links to Al Qaeda. Three days later, Salafi-led mobs attacked US embassies in Cairo and Tunis over an American-made film that lampooned the prophet Mohammed.

Mezmi and his friends blame such excess in part on a shaky grasp of religion. Several Salafi-led demonstrations in Tunisia have turned violent after hordes of young men ? some perhaps Salafis, some apparently just poor and angry ? seized the occasion to brawl with police.

?If Abou Iyadh calls for a demonstration, thousands of Salafis will turn out,? Mezmi says, citing a prominent Tunisian Salafi. ?But so will thousands of other guys, because they?re Muslims, and some of them are ignorant and throw stones.?

The solution, they say, is better knowledge of Islam.

?We have sheikhs in Tunisia and abroad, like in Saudi prisons and in Yemen,? says El Arabi. ?Their teachings are available online.?

WORKING WITHIN THE SYSTEM

However, that sort of ad-hoc study invites extremist ideas, says Mr. Ferjani, from Ennahda. His party wants to tackle job-creation while also training mainstream religious teachers to coax Salafis from society?s margins into political life.

In Egypt, that has already begun. Salafis generally stayed out of politics under Mr. Mubarak?s rule. Some objected on religious grounds to any semblance of democracy, however flawed. Others preferred to sit out a rigged game. But recently some have changed tack.

The Salafi Nour Party won nearly a quarter of seats in Egypt?s lower house of parliament, which has since been dissolved, in elections last year. It sees politics as a way ?to express our own point of view, to have pressure power, and to participate in the next government,? says spokesman Nader Bakkar.

The Nour Party wants to put its stamp on Egypt?s new constitution. It strove to make a more direct connection to sharia via an article making the ?principles of sharia? the main source of legislation and pushed hard ? if unsuccessfully ? for Cairo?s Al Azhar University, a leading Islamic authority, to vet laws for sharia compliance.

The prospect of Salafis in politics has gotten mixed reviews. While some Egyptians prefer them to the slick businessmen who rose to power under Mubarak, others worry of a clampdown on personal freedoms. As a Cairo taxi driver named Hossam put it, ?they?ll make us stop listening to music and grow our beards.

In Tunisia, a leaked video in October showing Ennahda?s leader, Rached Ghannouchi, advising Salafis to work gradually, prompted liberals to cry conspiracy. Ennahda said the remarks, recorded last April, were taken out of context.

?Politics could bring an element of realism to [Salafis?] perceptions and approaches,? argues Ferjani. ?They must make an adjustment, and that can only happen within the sphere of democratic interaction.?

DEMOCRACY VS. ISLAM?

In Tunisia, the newly-minted Reform Party hopes to play that role, says its president, Mohamed Khoja. Two decades ago his activity in underground Islamist circles earned him ten months in Ben Ali?s jails. Today his party wants to channel resurgent Salafi energy into politics.

?It?s not a choice between democracy and Islam,? he says. ?The people can have political authority ? what matters is that governance is Islamic and law adheres to sharia.?

For now, Mr. Khoja and his party are trying to win the ear of young Salafis. Winning their support may prove difficult. Many reject democracy as un-Islamic.

??God?s governance but the people?s authority? ? that?s just philosophizing,? says Mezmi, using a term that in Islamic parlance often equates to ?splitting hairs.?

He and his friends want to refashion society, but through other means than electoral politics.

?Governance should be what comes to us from God,? says El Arabi. ?Not communism, not liberalism, not secularism. Only Islam.?

Bankruptcy Court Warns on WARN

Judge Martin Glenn of the United States Bankruptcy Court for the Southern District of New York recently dismissed a putative class action complaint filed on behalf of former employees of MF Global that alleged the chapter 11 trustee for MF Global Holdings Ltd. and certain of its subsidiaries and the SIPA trustee for MF Global Inc. failed to provide sufficient notice under the federal Worker Adjustment and Retraining Notification Act (the ?WARN Act?) and the New York version of the WARN Act prior to terminating such employees.? In its memorandum opinion and order, the bankruptcy court considered whether the SIPA trustee and chapter 11 trustee were ?employers? for purposes of the WARN Act and the NY WARN Act or ?liquidating fiduciaries? who are excepted from the obligation to comply with advance notice requirements under the WARN statutes, in which case the actions of the trustees would be protected.

On October 31, 2011, pursuant to the Securities Investor Protection Act, the United States District Court for the Southern District of New York entered the order commencing the liquidation of MF Global Inc., the U.S. broker-dealer arm of the MF Global enterprise, and appointed James W. Giddens as the SIPA trustee.? (Under SIPA section 78eee, upon the grant by the district court of the ?protective decree? and the appointment of the SIPA trustee, the liquidation proceeding is removed to the bankruptcy court.)? SIPA section 78fff(a), among other things, requires a SIPA trustee to liquidate the broker-dealer business.? That same day, the broker-dealer?s parent company, MF Global Holdings Ltd., and its affiliated financing company, MF Global Finance USA Inc., filed voluntary chapter 11 petitions.? Approximately two weeks later, on November 11, 2011, the putative class members were dismissed from their employment.? On November 21, 2011, the debtors and the statutory creditors? committee filed a joint emergency motion seeking the appointment of a chapter 11 trustee, which the court granted a week later.

The only purpose of the SIPA proceeding for the MF broker-dealer (which employed the bulk of the terminated MF employees) could be liquidation.? The stated purpose of the chapter 11 filings, however, was less clear. ?Although the first day affidavit and the statements at the first day hearing indicated that the MF Global chapter 11 cases were filed with the hope of reorganizing, these statements conflicted with those made in the emergency motion seeking the appointment of a chapter 11 trustee ?to reorganize and/or liquidate the [d]ebtors? assets for the benefit of the . . . estates,? which also stated that ?[t]he primary objective for the duration of the chapter 11 cases is the orderly wind-down of the [d]ebtors? various assets.?? The bankruptcy court observed, ?With the appointment of the Chapter 11 Trustee on November 28, 2011, it became clear that the only possible outcome for the chapter 11 [d]ebtors was liquidation.? But between October 31, 2011 and November 22, 2011, there is nothing in the record to establish that the chapter 11 [d]ebtors intended to liquidate.?

Having established the differing original objectives of the SIPA proceeding and the chapter 11 cases, Judge Glenn then considered whether the trustees were ?employers? for the purposes of the WARN statutes.? Both trustees relied upon the preamble to the explanatory WARN Act Regulations issued by the Secretary of the Department of Labor to exclude themselves from the definition of ?employer.?? As a matter of law, the bankruptcy court concluded that the MF broker-dealer was liquidating when the layoffs occurred because the SIPA trustee was empowered by law only to liquidate the business, and as such, the SIPA trustee was a ?liquidating fiduciary? and did not fall within the definition of ?employer.?? Accordingly, the SIPA trustee was excepted from the obligation to comply with the advance notice requirements under the WARN statutes.

Although the bankruptcy court also granted the chapter 11 trustee?s motion to dismiss, it did so without prejudice and without basing its decision on the ?liquidating fiduciary? principle.? Unlike the SIPA trustee?s motion to dismiss, disputed issues of fact existed with respect to the chapter 11 debtors.? Moreover, the class action complaint itself did not allege whether the debtors were seeking to reorganize or to liquidate.? Having concluded that the allegations in the complaint were deficient, the court granted the chapter 11 trustee?s motion to dismiss, but also granted the putative class representatives leave to amend their complaint within thirty days.? The bankruptcy court noted, however, that any subsequent amendment of the complaint would not preclude the court from dismissing the amended complaint based on the ?liquidating fiduciary? principle.

(AP) ? Justin Bieber faced a hostile homecoming during his halftime performance at Canada's football Grey Cup, facing boos and jeers.

The Toronto crowd booed Sunday when the 18-year-old pop star's face popped up on the JumboTron screen. They booed when a host spoke his name. And they booed as he took the stage and throughout his medley of the chart-topper "Boyfriend" and the disco-inflected "Beauty and a Beat."

If Bieber was bothered, it didn't show.

"Thank you so much Canada," Bieber said. "I love you."

Earlier in the week, Bieber was presented with a Diamond Jubilee Medal by Prime Minister Stephen Harper and caused a scene by wearing overalls, unbuttoned on one shoulder, over a white T-shirt, with a backwards baseball cap.

There was sufficient uproar that Harper even weighed in on Twitter.

"In fairness to (Bieber)," Harper tweeted Sunday, "I told him I would be wearing my overalls too."

The Canadian Football League may have been hoping to court Bieber's army of tween followers on Sunday. But recent Grey Cup halftime performers have skewed toward the comparatively heavy likes of Nickelback and Lenny Kravitz.

"J-Biebs doesn't scream football, you know? Neither does Carly Rae Jepsen," said Calgary's Ryan Prisque, 22.

The 27-year-old Jepsen also received a mixed reaction at first Sunday but won the crowd over during an enthusiastic medley of her latest single, "This Kiss," and her infectious hit "Call Me Maybe."

Regardless of industry or the existing levels of competition, starting any form of business provides a whole host of challenges. These are often magnified online, where you need to learn a number of new proficiencies just to get your idea off the ground. From designing a site to building an audience, starting a business online isn?t easy.

Like most businesses, identifying a large enough niche to operate within is critical to your online success. Before you do anything, be sure you understand what, if anything, makes your proposition unique. With global competition and thousands of companies vying for visitors, complete individuality is almost impossible.

Now for most online businesses, their products or services will not be unique as not everyone can be the next James Dyson and come up with a revolutionary product.

So whilst your aim shouldn?t be to reinvent the wheel, you should be trying to find a new way of selling the wheel. What this mean is you should be looking for ways of segmenting your industry into something where you could become a specialist. A great example of this is the insurance provider Sheilas? If your niche is so small that even if you dominated the market for it your return is going to be minimal, then you might want to go back to the drawing board.

?2. Realistic Budgets

One of the biggest reasons online businesses do not succeed is because owners don?t set realistic budgets for development and marketing. Whilst the internet is full of Web Developers and Online Marketing professionals offering up their services for next to nothing, be wary; like most things in life, you get what you pay for and online services are no exception. If you want an all-encompassing website then be prepared to pay for it. Web Development and Online Marketing are specialised fields and require a high degree of both creativity and technical knowledge ? all of these skills will come with a cost.

3. Online Marketing 1: SEO

You also need to think about how you?re going to promote your site and get people looking at it and purchasing from you. In most instances, you?re going to need to be thinking about Search Engine Optimisation (SEO) and Pay-per-Click (PPC) ? both of which are great ways of getting people to your site via search engines like Google, Yahoo! and Bing.

This involves structuring a site in such a way as to allow it to rank favourably within the organic search results. In order to do this, you will also need to be thinking of ways of getting other sites to link back to you and thus demonstrating to search engines your content is worthwhile and valued. If you?re thinking about getting an SEO consultant on board, make sure they only use what are known as ?White Hat? techniques that comply with Google Guidelines. By breaking the search engine?s strict rules, you run the risk of being penalised. PPC is one of the most cost effective and immediate ways of generating substantial volumes of traffic to your site, but it can prove an extremely costly endeavour if not done effectively. If you?re looking to employ a PPC consult, make sure they are AdWords Certified, which will mean that they have passed a number of examinations from Google and demonstrates they know the AdWords product and will usually be in a good position to get you results.

Most hosting packages are no more than a couple of hundred pounds a year, if that, and you don?t want to lose out on business with your site being down just for the sake of saving a bit of money on hosting.

?7. Profiles

You should also be thinking about securing as many social profiles as possible in your name. Make sure you?ve got a branded page on sites like Twitter, Google+ and Facebook. All of these social platforms have millions of users signed up and interacting each and every day and if a potential client is on one of these platforms, you need to ensure you?re on there and presented in the best possible light.

?8. Performance Tracking

Every website that?s serious about doing business online needs to have, as a minimum, both Google Analytics and Google Webmaster Tools set up on the site. Both of these packages are free to sign up to and will give you invaluable data about the performance of your website. However, it?s not simply good enough to just know how many people visited your site last week, you also need to know how many people who visited your site resulted in a conversion ? be it a sale, registration or an enquiry. All of these actions will be business critical to the site; things like enquires could either be someone emailing you or picking up the phone and calling you.

In light of this, make sure you have conversion tracking in place in Google Analytics and if you can afford it, sign up to a call tracking programme that will be able to tell you exactly how many phone calls have been generated. This data will then give you a far greater understanding of your online business and give you the information you need to be able to make informed decisions.

?9. Security

The security of your site and the data collected off customers is of paramount importance. You don?t want your site being hacked, thus preventing you from making sales, so make sure things like passwords and hosting is secure. Also, you will need to be thinking about how you?ll be taking payments on your site. Make sure this is secure as well and if needs be, get someone on-board who specialises in e-commerce payments.

?10. Maintenance & Development

Finally you will need to think about the long game. In light of this, be sure you have the knowledge needed either internally to maintain a website and develop it further ? if you don?t have this in place, I would seriously recommend out-sourcing it to an appropriately qualified Web Developer to ensure your site works as needed for every possible customer visiting your site.

Cheryl and Larry are seeing red.

But they're not angry so much as they're frustrated, anxious and a little perplexed about how they could be racking up debt after all they've been through over the past few years.

Larry's, Cheryl's finances

INCOME:

Larry: $81,619 ($5,395 net a month)

Cheryl: $38,000 ($2,202 net a month)

MONTHLY EXPENSES: $3,936

DEBTS:

Car loan: $12,000 owing at zero interest

Mortgage: $50,000 owing; 5.15 per cent fixed rate

Larry credit cards: $6,600, 19.99 per cent

Cheryl credit card: $1,000; 19.99 per cent

Cheryl Group RRSP: $3,468

NET WORTH: $117,907

"We are both trying to re-establish our credit after finishing a consumer proposal in the last year," says Cheryl, 41.

"We owned a small business and incurred a lot of debt while running it."

The couple, who both work in sales, grossed almost $120,000 combined last year or about $7,757 in take home pay a month.

Despite the six-figure family income, the parents of two young children have virtually no savings. Larry has no work pension and Cheryl only recently enrolled in hers.

Yet they have racked up their credit cards to the tune of $6,600, and they've done so only in the last six months after individually applying for credit without telling each other.

Although they have little other debt -- they owe $50,000 on the house and have a car loan -- balancing their household budget is an elusive goal.

In the past, Cheryl has largely left managing the finances to Larry, but she now realizes she will have to play a bigger role.

"Larry doesn't know where his stuff is half the time and he's very laissez-faire about money," she says.

"Considering we just paid off the consumer proposal, really scrimping and saving in, we were hoping to get a little breathing room, but it seems our situation hasn't improved at all."

Debt counsellor Christi Posner says, on paper, this couple should be in good shape financially because their income far exceeds their expenses. Yet they are still struggling.

"What this tells me is that there is a deeper issue here," says Posner, with the non-profit agency Credit Counselling Society.

"Debt is merely the symptom of a larger underlying problem."

At the heart of their problem is poor communication. One hand doesn't know what the other is doing.

"The two of them have kept separate bank accounts, and secret credit cards have been applied for and used," she says. "Secrets about spending, saving and debt get in the way of open and honest communication and can be detrimental to personal relationships; this is called financial infidelity."

And it can be very destructive to a family's well being -- both financially and emotionally. Fortunately, Larry and Cheryl are not deeply in debt, and they have overcome a major financial setback -- the failure of a business.

Posner says the prescription to their problem is straightforward. They need to talk regularly about finances.

"They should start with something routine, such as how to better utilize Cheryl's free bank accounts to organize household bill payments, or how to set limits on spending," she says.

Of course, sitting down to discuss finances can be an uncomfortable experience at first because it can lead to conflict. But this is natural and even productive because they will learn where they both stand regarding saving, spending and their future.

It's all about values, Posner says.

"Simply put, values are about what's important to us," she says. "If Larry and Cheryl argue about money, the real issue they're arguing about may be much deeper and harder to see."

Values are built on past and present experiences and relate to our education, upbringing, culture, age, gender, work experience and even health.

"When it comes to our finances, we tend to spend money on things we value."

For example, someone who values security usually saves and avoids debt. But another person may value excitement and freedom, and spending money is a way to express that.

In a relationship, people with different values can still get along quite well, but they need to be open about their differences.

Once Larry and Cheryl are talking, they can begin focusing on the numbers, and a good place to start is their expenses. Posner says this is a red flag in their situation because they're obviously underestimating their costs.

"The list of expenses submitted by Larry and Cheryl total $3,936 a month," she says. "That means that there is over $3,600 that is unaccounted for every month."

Their budget, however, seems to be missing a number of important costs, such as gasoline, car repairs, clothing, entertainment, gifts and hair care.

"After adding in averages for those and other categories, I estimate their expenses are likely closer to $5,866, but that still leaves over $1,700 unaccounted for monthly."

For the next couple of months, they need to track their spending, aiming to reduce discretionary costs between five and 10 per cent.

Posner says one particular area where they likely can trim expenses is ATM withdrawals.

"Over a 30-day period, there were $1,600 in ATM withdrawals from Larry's account, which will be very hard to trace back," she says. "I recommend limiting any cash withdrawals unless they are living on an all cash system and tracking each penny."

Once they get a handle on where the money is going, they can start focusing on the future. This involves building a budget they can live with that incorporates paying the bills, having a little fun, saving for the future and eliminating their debt.

They certainly earn enough money to address all goals, but their short-term focus should be eliminating the credit card debt. Allowing high interest debt to linger is an enormous waste of their money.

"By making minimum payments only, it will take Larry and Cheryl over 50 years to repay their credit card," Posner says.

And they have no reason to be making only the minimum payments. The couple should easily be able to come up with a plan to pay off the cards in six months -- paying about $635 in interest -- while still working toward their other financial goals.

And among those goals should be setting money aside for emergencies, which is just as important as saving for college and retirement.

"Larry's income fluctuates from month to month, so it is essential they put money aside when he earns extra income to help out when he earns less income," she says.

Once they're on track, building up a 'just-in-case' reserve to cover six months of expenses, then they can start thinking about saving more for the long-term.

And Larry and Cheryl have lots to think about. Their future is promising, Posner says.

They just need to talk regularly and honestly about their finances.

"It's all about working together as a team toward the same goal."

Hubble eyes a loose spiral galaxy

ScienceDaily (Nov. 23, 2012) ? The NASA/ESA Hubble Space Telescope has spotted the spiral galaxy ESO 499-G37, seen here against a backdrop of distant galaxies, scattered with nearby stars.

The galaxy is viewed from an angle, allowing Hubble to reveal its spiral nature clearly. The faint, loose spiral arms can be distinguished as bluish features swirling around the galaxy's nucleus. This blue tinge emanates from the hot, young stars located in the spiral arms. The arms of a spiral galaxy have large amounts of gas and dust, and are often areas where new stars are constantly forming.

The galaxy's most characteristic feature is a bright elongated nucleus. The bulging central core usually contains the highest density of stars in the galaxy, where typically a large group of comparatively cool old stars are packed in this compact, spheroidal region.

One feature common to many spiral galaxies is the presence of a bar running across the center of the galaxy. These bars are thought to act as a mechanism that channels gas from the spiral arms to the center, enhancing the star formation.

Recent studies suggest that ESO 499-G37's nucleus sits within a small bar up to a few hundreds of light-years along, about a tenth the size of a typical galactic bar. Astronomers think that such small bars could be important in the formation of galactic bulges since they might provide a mechanism for bringing material from the outer regions down to the inner ones. However, the connection between bars and bulge formation is still not clear since bars are not a universal feature in spiral galaxies.

The galaxy ESO 499-G37 lies in the southern border of the constellation of Hydra, which is shared with Antlia.

ESO 499-G37 was first observed in the late seventies within the ESO/Uppsala Survey of the ESO (B) atlas. This was a joint project undertaken by the European Southern Observatory (ESO) and the Uppsala Observatory, which used the ESO 1-metre Schmidt telescope at La Silla Observatory, Chile, to map a large portion of the southern sky looking for stars, galaxies, clusters, and planetary nebulae.

This picture was created from visible and infrared exposures taken with the Wide Field Channel of the Advanced Camera for Surveys. The field of view is approximately 3.4 arcminutes wide.

(AP) ? Rory McIlroy moved to the top of the leaderboard with a 5-under 67 Friday in the second round of the Dubai World Championship.

The top-ranked golfer, who missed several makeable putts on the front nine and then saw an eagle putt roll past the hole on 14, tied Luke Donald (68) and Marc Warren (67) at 11-under 133.

"I continued driving the ball well today and gave myself plenty of opportunities," said McIlroy, who has already won the European and PGA tour money titles. "Missed a couple of short ones on the front nine for birdies. But apart from that, it was a very solid round of golf and obviously in good position going into the weekend."

Sergio Garcia, playing for the first time since having laser eye surgery, matched the course record with an 8-under 64.

Garcia started with four birdies on his first five holes and then had a string of birdies at the turn before holing a long putt for eagle on 14. But he shot into the water on 16 for a triple-bogey before recovering to finish with a birdie and eagle.

"Coming back from a long break, so trying to get some good vibrations going and I managed to finish better than that," said Garcia, who is tied for 18th.

Donald joined McIlroy and Warren at 11 under with a short birdie putt on the 18th. Warren had a chance take the outright lead, but his 12-foot putt on the 18th came up short.

"Obviously, haven't dropped a shot in 36 holes, so feel good about that," said Donald, who finished with four birdies in a bogey-free round. "I had some opportunities, 10-foot, 15-footers on a few holes that I just misread. But that was a solid round of golf."

Donald said he wasn't getting his approach shots as close to the pin as the first day, but made up for it with the putter, including a difficult birdie on No. 9 and nice par save on 12.

"When I have myself a little bit of trouble out on the course, I was able to recover with the putter," Donald said.

The 189th-ranked Warren, who has not won a tournament since 2007, matched the second-ranked Donald's opening birdie and had five more, including a 12-footer on the 16th to move him into a tie with McIlroy.

"It was nice to be the Scot in the pack with the Englishman and the Northern Irishman," Warren said. "It's great to be in contention with guys like that. Looking down the leaderboard, it's a high-quality leaderboard and doesn't get any better anywhere in the world really."

It was also a good day for the South Africans as 2010 British Open champion Louis Oosthuizen (67) is only one stroke behind. He was joined at 134 by four-time tour winner Branden Grace (67).

Charl Schwartzel (67) and Richie Ramsay (68) were two shots off the pace, followed by another 10 players three strokes behind.

Several big names faltered, including fourth-ranked Lee Westwood (74). Two shots off the lead after the first round, Westwood bogeyed the 12th and 16th and then double-bogeyed the par-3 17th to fall eight shots off the lead.

Padraig Harrington, also two shots back after the first round, is five behind after a 71.

Judge grants Samsung's request for a look at HTC and Apple settlement agreement

A few days back Samsung asked the courts for the terms of the settlement agreement between HTC and Apple, and this evening US Judge Paul S. Grewal granted the request. Samsung is curious because they believe that some of the licenses cover those special user experience patents that Apple is quick to claim are infringed. Samsung claims that their determination of whether or not those patents were licensed will help decide if they need to stop production of devices named in prior lawsuits.

Simply put, Samsung believes that if this agreement shows that Apple is fine with another company using these patents after a payment, then that billion dollar judgment awarded to Apple ought to cover it and no further proceedings are needed.

This one isn't going away any time soon, folks.

Play Store now pushing potential Nexus 4 buyers to T-Mobile

If you've given up refreshing the Play Store listing for the Nexus 4, we wouldn't blame you at this point. There's no indication when these will be back in stock from Google directly, and that's really unfortunate. If you do happen to go to the Play Store though, you'll be greeted with a "Special Offer from T-Mobile" notice. If you follow the link, you're taken to T-Mobile's online store to buy it on-contract for $199. Curiously enough, this is showing up on both the 8 and 16GB models -- odd considering that 16GB is the only capacity sold by T-Mobile.

This really doesn't make any sense to us. Google has put the Nexus 4 at an extremely aggressive price point, one that's meant to show the great value of buying it directly from the Play Store. Pushing users to the more expensive on-contract option just because its out of stock at the moment is very odd. Google pushing the device with a contract from T-Mobile seems to go directly against what it's trying to accomplish with the "Devices" section of the Play Store.

Money Saving Tips for your Holiday Entertaining

It?s the most wonderful time of the year!

Who doesn?t love all the family get-togethers, cookie exchanges, and other festive?gatherings this time of the year? It?s easy to be a guest, and sweep in with your carefully wrapped hostess gift; but what happens when hosting the family gathering has fallen into your hands? Do you head to the kitchen and plan out every dish and decoration carefully, or do you crawl into bed and wish for a miracle?

Personally? I fall into the first category. Last Easter, we had my husband?s family over for breakfast. The table was festively set, and the homemade waffles were accompanied by sausages, eggs, fruit and a variety of drink options ? not to mention I was 7 1/2 months pregnant at the time. Now as tiring as it all was, I was even prouder that I managed to do all of it on a very small budget. Here are a few of the tips that I keep in mind when preparing for a holiday event.

  1. Coupons & Sales ? Keep your eyes peeled well ahead of time for coupons that would lighten the grocery load. Be sure to note the expiration date of the coupons, and if need be, store them filed by the expiry date. Also be on the lookout for sales. Generally the lowest prices on the popular items will be right before the holiday (you?d be amazed at turkey prices right before Thanksgiving!) So if you can hold off purchasing the big items until close to the event, then you will likely save some money. And keep in mind using your coupons on a good sale price with save you even more cash!
  2. Scale Down Decor - I am always amazed at people who not only have the money to purchase the latest in season decor, but the space to store it! We have a very small house, and I generally try to work on a limited budget for all my festive activities, so I like to keep decor simple. I find bowls, baskets, and glass jars at thrift stores and garage sales, use items I find in nature or food and make simple but effective centerpieces and accent pieces for around the home. Here are a few examples of some simple centerpieces using the local harvest.
  3. Keep the Recipes Simple - There is no reason you need to use the most expensive ingredients, and in many cases, you can swap out an expensive ingredient in a recipe without losing taste. Most people like to get-together over the holidays to spend time with friends and family ? food is an added bonus. As long as it tastes good and is filling, no one will complain that there was no caviar and escargot. Personally I find people always prefer the simplest dishes :)
  4. Lunch instead of Dinner - Sometimes planning a big fancy meal can overwhelm you and your wallet. Consider having a gathering earlier in the day with a lighter meal or stick to hors d?oeuvres and drinks, or cut it right down to just dessert. I guarantee no one will complain about a dessert party!
  5. Potluck - It might seem a little taboo to ask guests to bring a dish, but I think you can judge based on the crowd. In most cases people are happy to make one dish and bring it along, especially when someone else is supplying the main dish, the house, the clean-up, etc. And if you are a little too controlling to let others choose their dish, perhaps you could create a list, with a recipes included, and ask them to sign up.
